Monica Lombardi has been representing clients in courts throughout Virginia, in courts-martials, administrative boards, EEOC mediation and other civil and criminal cases since she left active duty as a Coast Guard JAG in 2007. You will find below a representative sampling of some of the results of our cases.
LO, a Navy Sailor, came to me seeking an uncontested divorce. Even though he was about to deploy, we worked together to draft all of the necessary agreements, decrees and court documents and achieved an uncontested divorce with no children upon his return from deployment.
MH, a recently 100% disabled veteran, lost his job and needed an adjustment of his spousal and child support obligations. I negotiated a partial settlement of his spousal support and after a 2 hour hearing with the judge, the case was further continued by the judge. Since the parties wanted to reach a conclusion, we negotiated a settlement that removed his past child support arrearages, reduced the amount of spousal support due, and was ultimately approved by the judge.
AG, a marine, was charged with impeding an investigation and threatening witnesses, along with several other charges. At the Special Court-martial, we successfully defended AG against those charges and they were dropped by the government by the second day of trial.
JB, a Coast Guard officer, received a negative officer evaluation report. The rating chain did not follow Coast Guard regulations. We appealed to the Personnel Records Review Board and got portions of the eval removed from her record, so she can now go before the promotion board with a clean evaluation.
KA, a wife of an active duty Air Force member, was served with Virginia divorce and child custody papers while she was living in Idaho. Her husband was stationed in Virginia and she did not want to get a divorce in Virginia. I made a special appearance on her behalf and argued against the jurisdiction of the Virginia courts in this case. The judge required another hearing and significant case law pertaining to this issue, and with vigorous argument from both attorneys to help him decide the matter. The judge ultimately agreed with me, and the case was dismissed. The wife never had to come to Virginia to defend herself.
MW, another sailor who was about to deploy, came to me seeking a divorce. He wanted to give his wife a generous support agreement during the deployment, however, he wanted to get a divorce as soon as he returned. After the required separation period and upon his return from deployment, I brought his case into court, and the divorce sailed through.
SJ, the former wife of a retired military member, was entitled to a portion of his military retirement under their divorce decree. We search for him, found him in another state, and served him with the necessary court documents. After a lengthy hearing, the court awarded SJ her share of his retirement and ordered DFAS to make the payments directly to her.
As a former Coast Guard officer, my experience also extends to businesses and corporations that operate under federal regulations. Last year, an oil transfer terminal was being cited for numerous Coast Guard violations and faced over $75,000 in penalties. I successfully appealed the violation and reduced the penalties down to $9,500.
